Catonsville Divorce and Family Law Lawyer

Property division, retirement assets, custody and support for western Baltimore County families.

Catonsville sits in western Baltimore County along the Route 40 corridor, near the Howard County line and the UMBC campus. It is a settled community of older homes and academic, healthcare and public sector employment, and those characteristics show up in the property and support questions that arise in a divorce here.

Property division

Maryland is an equitable distribution state rather than a community property state. The court identifies which property is marital, values it, and then decides whether a monetary award is needed to reach a fair result. Nothing is automatically divided in half, and the name on the title does not answer the question.

In a community with long tenured homeownership, two issues recur. First, a house owned before the marriage but paid down with marital earnings is usually not entirely non-marital. Second, an inheritance that passed through a joint account may have lost its separate character. Both are tracing questions, and the burden falls on the spouse claiming the asset is non-marital. See property and debt division.

Retirement and pension assets

Academic, healthcare and public sector careers frequently produce pensions and retirement accounts that are worth more than people assume, and that are easy to overlook because only one spouse’s name appears on the statement. The portion earned during the marriage is generally marital property. Actually dividing such an account normally requires a separate court order directed to the plan administrator, which is a step that has to be completed rather than merely agreed to.

Custody and child support

Maryland separates legal custody, meaning long term decision making authority, from physical custody, meaning where the child lives day to day. Custody is decided on the best interests of the child, with no presumption favoring either parent.

Child support follows the statewide income shares guidelines, and the parenting schedule affects the calculation once a parent reaches at least 92 overnights per year. See custody and parenting plans and child support.

Update your estate plan afterward

A divorce does not automatically correct every document that names a former spouse. Beneficiary designations on retirement accounts and life insurance, deeds, wills and powers of attorney generally need review once the case concludes. This is a genuinely common oversight and an avoidable one. See estate planning.
