Essex and Middle River Divorce and Custody Lawyer

Divorce and custody representation for eastern Baltimore County, including custody cases for parents who were never married.

Essex and Middle River are eastern Baltimore County communities along the water, with a mix of long tenured homeowners and younger families. Cases from this area frequently involve both a divorce and a custody dispute at the same time, and sometimes custody alone where the parents were never married.

That last point matters. You do not have to be divorced, or ever have been married, to need a custody and support order. The process is different but the standard is the same.

Custody

Maryland decides custody on the best interests of the child. There is no presumption favoring either parent. Legal custody is decision making authority over education, religious training, discipline and non emergency medical care. Physical custody is where the child lives day to day. The two can be arranged differently.

Courts weigh factors including which parent has been the primary caregiver, the fitness and character of each parent, the child’s preference depending on age and maturity, the geographic proximity of the homes, and each parent’s ability to support the child’s relationship with the other. See legal custody, physical custody and parenting plans.

Divorce

Maryland now recognizes only absolute divorce. Limited divorce was repealed in 2023 and Maryland has no legal separation status. The available grounds include a six month separation, which can now be satisfied while living under the same roof if the spouses are genuinely leading separate lives, irreconcilable differences, and mutual consent where there is a complete signed agreement. See grounds for divorce in Maryland.

Support and temporary relief

Child support follows Maryland’s income shares guidelines and is affected directly by the parenting schedule once a parent reaches at least 92 overnights a year. Where a family cannot wait for the case to conclude, temporary custody, access and support can be set at a pendente lite hearing.

See child support.

Waterfront and recreational property

Where a family owns waterfront property, a boat, or a second property, those assets need to be identified, characterized as marital or non-marital, and valued like any other. Property held before the marriage but maintained with marital funds is rarely as separate as people expect. See property and debt division.

Where your case is filed

Essex and Middle River cases go to the Circuit Court for Baltimore County at 401 Bosley Avenue in Towson. The court refers many family matters to mediation and offers family support services including supervised visitation and monitored exchanges where those are ordered.
