A step-parent adoption makes a legal parent out of someone who has already been acting as one. It is one of the few proceedings in family law that people arrive at happy, and it is usually the most straightforward adoption Maryland recognizes. It is still a court case with real requirements, and the hardest of them is almost always consent.
Where step-parent adoption fits
Maryland sorts adoptions into three categories: public agency adoptions filed by a department of social services after parental rights have been terminated, private agency adoptions, and independent adoptions. A step-parent or co-parent adoption is an independent adoption, filed by a private party rather than by an agency.
Consent is the central issue
A child cannot have three legal parents. For a step-parent to become a legal parent, the child’s other legal parent generally has to consent and give up their parental rights, and that parent must be given notice and an opportunity to object if they can be located.
That is the point where most step-parent adoptions either move quickly or become contested. Where the other parent agrees, the case is largely paperwork and a short hearing. Where the other parent cannot be found, or objects, or has had no meaningful involvement for years, the case becomes considerably more involved and the analysis turns on facts specific to your family. This is worth discussing before anything is filed rather than after.
The child’s own voice
Maryland treats age 10 as a threshold in adoption cases. A child who is at least 10 has rights in the proceeding, including the right to a lawyer in certain adoptions. As a practical matter, an older child’s wishes carry weight, and most families want the child to be genuinely on board rather than merely present.
What the process generally involves
- Confirming the child’s legal parentage and who must consent or be served
- Preparing and filing the petition in circuit court
- Notice to the other legal parent, and their consent or their objection
- Background and suitability information about the adopting step-parent
- A hearing, after which the court may grant the adoption
- An amended birth certificate reflecting the new legal relationship
What the court is deciding, in the end, is whether the adoption is in the child’s best interests. That is the same standard that governs custody, applied to a permanent change rather than a schedule.
What changes afterward
An adoption is permanent. The step-parent becomes the child’s legal parent for every purpose: decision making, support, and inheritance. The other parent’s rights and their child support obligation end. That last point surprises people, so it is worth being clear about it in advance. See child support.
An adoption is also a good moment to revisit wills, beneficiary designations and guardianship provisions, since the child’s legal status has changed. See estate planning.
